SMI: authorities will not intimidate taxpayers

JAKARTA. The Finance Ministry’s Directorate General of Taxation will not conduct law enforcement related to the implementation of tax amnesty. Director General of Taxation, Ken Dwijugiasteadi said on Monday night (8/1), The Directorate General of Taxation will stop all investigation processes related to tax crimes to support the tax amnesty program.

According to Article 2 of the Tax Amnesty Law, a tax amnesty should be conducted under the principles of legal certainty, fairness, expediency, and national interests.
Article 3, Paragraph (3) of the Tax Amnesty Law also stipulates that taxpayers may request an amnesty except if they are being investigated and their investigation file has been completed or they are undergoing a criminal penalty in the taxation area.

Finance Minister Sri Mulyani Indrawati also said she will stop all investigation processes related to tax crimes to support the policy. Taxpayers fear investigation of criminal offenses in the area of taxation. “The taxation authorities will not apply pressure and will not intimidate taxpayers,” the minister emphasized.

President Joko Widodo (Jokowi) had earlier stated that the tax amnesty was being offered not only to conglomerates but also to small and medium enterprises.
“The tax amnesty policy concerns only taxation. Do not politicize the policy,” Jokowi remarked while addressing some 10 thousand business leaders attending a government campaign to disseminate information on the tax amnesty program.

Jokowi said the opportunity is available only until March 2017 to make use of the tax amnesty policy as in 2018, tax information will be open between countries.
The president guaranteed the confidentiality of data on taxpayers using the tax amnesty program. “The data may not be used for legal investigation and may not be given to anyone. One found leaking the data is liable to face a punishment of up to five years in jail,” he remarked.

Jokowi said law enforcement agencies, including the attorney general, police chief, and head of PPATK, will offer support for the implementation of the tax amnesty policy. The president said with the implementation of the tax amnesty policy, the country could hope to finance its development programs through funds from the private sector.

“Construction of toll roads and seaports do not have to be financed by funds from the state budget. The state funds could then be used more for rural development, healthcare, and education, among other areas. This is the program,” Jokowi added.
